Ministry of Labor's guidelines for pregnant migrant workers: whether employers can hire more workers and provide subsidies is yet to be discussed
To protect the rights of pregnant migrant workers, the Ministry of Labor plans to formulate guidelines for migrant workers' pregnancy and invites relevant units to discuss. Whether employers can hire more workers during the migrant workers' pregnancy is still under discussion. Whether to provide subsidies to migrant workers who are pregnant without labor insurance is also under consideration.
The case of missing migrant workers' children being abused due to childhood abuse has attracted attention. The Ministry of Labor has summarized international protection for migrant workers' pregnancy and combined various domestic resources to formulate pregnancy guidelines centered on the rights of migrant workers, hoping to improve assistance before and after migrant workers' pregnancy and ensure the rights of migrant workers and employers.
The Ministry of Labor recently invited private groups and related units to discuss and collect opinions. The Ministry of Labor officials pointed out that the Ministry of Labor's guidelines for migrant workers' pregnancy include assistance measures for migrant workers before pregnancy, after pregnancy, during childbirth, and after childbirth. It not only includes the rights of migrant workers, but also considers the feasibility of employers' implementation.
Officials gave an example. If a domestic worker claims to apply for parental leave when she is pregnant, the employer cannot refuse according to the law. However, the employer's care needs must also be taken into account. Therefore, whether the employer can hire more manpower during the migrant worker's pregnancy remains to be discussed.
In addition, officials mentioned that they are currently planning whether to provide financial assistance to migrant workers for childbirth. For example, industrial migrant workers who have joined the Labor Insurance can receive Labor Insurance childbirth benefits, but domestic migrant workers who have not joined the Labor Insurance cannot receive childbirth benefits. However, this part involves rationality, so it is still under planning and consideration.
